Terms of Service

1. Agreement and provider

These Terms are an agreement between you and MAK Software Solution, the provider of Cast Garage. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy.

2. Eligibility

You must be at least 16 and legally able to enter into this agreement. Cast Garage is not intended for children under 16.

3. Accounts

You are responsible for keeping your account secure and for activity performed through it. Account information must be accurate, and you must notify us promptly if you believe your account has been accessed without authorization.

4. The service

Cast Garage provides tools to identify die-cast vehicles, maintain a personal collection, and browse catalog information. Features may change as the service develops.

5. Identification and catalog information

Photo identification and catalog results may be incomplete or wrong. They are suggestions for collection management, not professional valuations, authenticity certificates, or guarantees of rarity, condition, ownership, or market price. You should review and correct information before relying on it.

6. Your content

You retain ownership of photos, collection records, notes, and other content you submit. You grant the provider a limited, worldwide, non-exclusive license to host, process, transmit, and display that content only as needed to provide, secure, and maintain the features you use. This license ends when the content or account is deleted, subject to limited backup, legal, and security retention described in the Privacy Policy. Your private content is not licensed for public catalog publication or AI-model training without a separate, explicit agreement.

7. Acceptable use

You may not:

• use the service in violation of law or another person’s rights;
• upload content you do not have permission to use;
• attempt to bypass quotas, security controls, or access restrictions;
• interfere with or disrupt the service or other users;
• use automated methods to scrape or extract the catalog at scale; or
• reverse engineer the service except where law expressly permits it.

8. Intellectual property

The Cast Garage application, branding, software, and original service content are protected by intellectual-property laws. Vehicle, manufacturer, and product names or marks belong to their respective owners. Their appearance in catalog information does not imply endorsement or affiliation.

9. Store purchases and subscriptions

If paid features are offered, purchases and subscriptions are handled by the applicable app store and are also subject to its terms. Prices, renewal terms, and available cancellation controls are shown by the store before purchase. Deleting a Cast Garage account does not automatically cancel a store subscription; you must manage or cancel it through the store account that made the purchase.

10. Suspension and termination

You may stop using the service and delete your account at any time through the app or the account-deletion page. Access may be limited or suspended when reasonably necessary to protect the service, comply with law, investigate abuse, or address a material violation of these Terms. Where appropriate, notice and an opportunity to resolve the issue will be provided.

11. Availability and changes

The service may occasionally be unavailable for maintenance, security, or reasons outside the provider’s control. Features may be changed or discontinued, subject to any notice required by law.

12. Disclaimers

To the extent permitted by law, the service is provided “as is” and “as available,” without warranties that it will always be accurate, uninterrupted, secure, or suitable for every purpose. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

13. Limitation of liability

To the extent permitted by law, the provider is not responsible for indirect, incidental, special, or consequential losses, loss of data, lost profits, or business interruption arising from use of the service. The provider remains responsible for reasonably foreseeable direct loss caused by a breach of these Terms. Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where it cannot be limited, or any mandatory consumer right that applicable law does not allow the parties to exclude.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, without overriding mandatory consumer protections that apply where you live. Please contact us first so we can try to resolve a dispute informally. If it cannot be resolved, disputes are subject to the competent courts in the Republic of Serbia, unless mandatory law gives you the right to bring a claim elsewhere.

15. Changes to these Terms

The current version and effective date will remain available on this page. Material changes will be communicated through the app or another appropriate method when required.

16. General terms

If a provision of these Terms is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without permission. The provider may transfer these Terms as part of a lawful business transfer, subject to required notice and your mandatory rights.
